These Terms of Service ("Terms") govern your use of Untymed, including the mobile app, website, and related services ("Services").
By using Untymed, you agree to these Terms.
If you do not agree to these Terms, do not use Untymed.
About Untymed
Untymed is a personal finance and time-awareness tool designed to help users understand purchases in relation to work time and personal effort.
Untymed is intended for personal informational use only.
Agreement Between You And Untymed
These Terms constitute an agreement solely between you and Untymed. Apple Inc. ("Apple") is not a party to these Terms and is not responsible for the Services or their content.
If you download or access the Untymed app through the Apple App Store, the additional terms set out in the App Store Supplemental Terms section below shall also apply.
Eligibility
You must be at least 13 years old to use Untymed.
If you use Untymed on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
License
Subject to your compliance with these Terms, Untymed grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- download and install the app on devices you own or control;
- access and use the Services for your personal, non-commercial purposes.
This license does not grant you any right to resell, sublicense, distribute, or otherwise exploit the Services or any part thereof.
Untymed reserves all rights not expressly granted in these Terms.
No Financial, Legal, Or Tax Advice
Untymed does not provide financial, investment, accounting, legal, or tax advice.
Calculations, insights, summaries, projections, and time-based interpretations are informational only and should not be relied upon as professional advice.
You are solely responsible for financial decisions made using information generated by Untymed.
Your Data And Entries
You are responsible for the accuracy of the data, entries, imports, schedules, income values, categories, and settings you provide.
Time-cost calculations and insights depend entirely on the information entered into the app.
Untymed is not responsible for incorrect calculations caused by inaccurate or incomplete user-provided data.
Local-First Functionality
Untymed is designed primarily as a local-first application.
Many features operate directly on your device without requiring account creation or continuous cloud synchronization.
You are responsible for maintaining access to your device, backups, and recovery methods.
Untymed may not be able to recover deleted local data.
Cloud Import Features
Some optional import features may require cloud-based processing, including OCR, parsing, extraction, or transaction preparation.
By using cloud import functionality, you authorize Untymed and its service providers to process uploaded files for the purpose of generating transaction candidates and related import data.
You should review imported results carefully before saving them.
Import results may be incomplete, inaccurate, duplicated, misclassified, or partially parsed.
Untymed does not guarantee the accuracy of imported transaction data.
iCloud Features
Untymed may use Apple's iCloud services to synchronize or back up app data across devices connected to your Apple account.
Your use of iCloud-related functionality is also subject to Apple's terms, conditions, and privacy practices.
Untymed is not responsible for outages, synchronization failures, data loss, or security incidents caused by Apple's infrastructure or third-party cloud services.
Subscriptions And Purchases
Untymed offers premium features ("Untymed Pro") through auto-renewing subscriptions made available exclusively via the Apple App Store. The following plans are currently offered:
- Monthly Plan — billed every one (1) month from the date of initial purchase.
- Annual Plan — billed every twelve (12) months from the date of initial purchase.
The applicable subscription price, billing period, and any introductory or promotional terms are displayed within the app at the point of purchase and are subject to Apple's then-current App Store policies.
Automatic Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled at least twenty-four (24) hours before the end of the current period. Your Apple ID account will be charged for renewal within twenty-four (24) hours prior to the end of the current period.
Cancellation. You may cancel your subscription at any time through your Apple ID account settings under "Subscriptions". Cancellation will take effect at the end of the current billing period; you will retain access to Pro features until that date. Untymed cannot process cancellations directly, as all subscription management is handled by Apple.
Refunds. All refund requests must be submitted to Apple in accordance with Apple's App Store refund policy, available at https://support.apple.com/HT204084. Untymed does not have the authority to issue refunds for App Store purchases.
Price Changes. Untymed may modify subscription pricing in accordance with Apple's policies and applicable law. Where required by law, you will be notified of any price increase in advance and given the opportunity to cancel before the change takes effect.
Feature Availability
Untymed is an evolving product.
Features, pricing, interfaces, integrations, availability, and supported functionality may change, be modified, be discontinued, or remain marked as "coming soon" without notice.
Untymed is not obligated to continue supporting any specific feature, integration, or workflow.
Acceptable Use
You agree not to:
- use Untymed for unlawful purposes,
- interfere with or disrupt the app or related services,
- attempt unauthorized access to systems or infrastructure,
- reverse engineer or exploit non-public portions of the app except where prohibited by law,
- abuse cloud import systems or infrastructure,
- upload malicious files or harmful content,
- or use Untymed in a way that could harm other users or the service.
Intellectual Property
Untymed, including its branding, design, software, graphics, interface elements, and related content, is owned by Untymed or its licensors and protected by applicable intellectual property laws.
These Terms do not grant ownership rights to users.
You retain ownership of the data and content you create or import into Untymed.
Privacy
Your use of Untymed is also governed by the Untymed Privacy Policy.
Third-Party Services
Untymed may rely on third-party providers and infrastructure, including Apple services, cloud hosting, OCR providers, analytics providers, email infrastructure, and related technologies.
Untymed is not responsible for outages, failures, interruptions, pricing changes, or actions caused by third-party services.
Disclaimers
Untymed is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Untymed disclaims warranties of any kind, whether express, implied, or statutory, including warranties of:
- merchantability,
- fitness for a particular purpose,
- non-infringement,
- availability,
- accuracy,
- or uninterrupted operation.
Untymed does not guarantee that the app will always function without bugs, interruptions, delays, or data loss.
Limitation Of Liability
To the maximum extent permitted by law, Untymed and its operators shall not be liable for:
- indirect,
- incidental,
- consequential,
- special,
- exemplary,
- or punitive damages,
including loss of profits, savings, data, business opportunities, goodwill, or financial losses arising from use of the app.
Untymed's total liability for any claim relating to the service shall not exceed the amount paid by you to Untymed during the twelve months preceding the claim.
Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you.
Termination
You may stop using Untymed at any time.
Untymed may suspend or terminate access to cloud-based features or related services if necessary to:
- maintain security,
- prevent abuse,
- comply with legal obligations,
- or protect the service and users.
Governing Law
These Terms are governed by the laws of Portugal, excluding conflict of law principles.
Any disputes relating to these Terms or Untymed shall be subject to the competent courts of Portugal unless otherwise required by applicable consumer law.
Changes To These Terms
Untymed may update these Terms from time to time.
Updated Terms will be made available within the app, on the website, or through other appropriate notice.
Continued use of Untymed after updated Terms become effective may constitute acceptance of the revised Terms where permitted by law.
Severability And Entire Agreement
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with the Untymed Privacy Policy, constitute the entire agreement between you and Untymed concerning your use of the Services and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral, relating to the subject matter hereof.
App Store Supplemental Terms
The following additional terms apply if you access or use Untymed through the Apple App Store:
Acknowledgment
You acknowledge that these Terms are concluded between you and Untymed only, and not with Apple. Untymed, not Apple, is solely responsible for the app and its content.
Scope Of License
The license granted to you in these Terms is limited to a non-transferable license to use the Untymed app on any Apple-branded device that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Maintenance And Support
Untymed is solely responsible for providing any maintenance and support services with respect to the app, as required by these Terms or applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.
Warranty
Untymed is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty shall be the sole responsibility of Untymed.
Product Claims
Untymed, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Claims
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Untymed (not Apple) shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Export Compliance
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Beneficiary
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary hereof.
